These terms govern your use of traceelementsprotocols.com and everything sold through it — coaching, downloadable protocols and any other program offered by Trace Elements Protocols LLC (“TEP”, “we”, “us”). By using this site or buying anything here, you agree to them. If you do not agree, please do not use the site.

1. What we are, and what we are not

TEP provides fitness coaching, nutrition guidance and general wellness education. We are not a medical practice. Tracy Mullane is not a physician, registered dietitian, nurse or other licensed healthcare provider, and nothing sold or published here diagnoses, treats, cures or prevents any disease.

Nothing on this site or in any program is a substitute for care from a licensed clinician. If you have a medical condition, take prescription medication, are pregnant, or have any symptom that concerns you, speak with your physician. Always consult your physician before beginning any exercise, nutrition or supplementation program, and stop immediately and seek medical attention if you experience pain, dizziness, chest discomfort or any other warning sign.

Where lab or blood work is discussed, your physician interprets your results. We use results only to inform training and nutrition planning and to suggest questions worth raising with your doctor.

Assumption of risk

Exercise carries inherent risk, including injury and, in rare cases, serious harm. You take part voluntarily and you accept that risk. You are responsible for exercising within your own limits, for the accuracy of the information you give us, and for telling us promptly if your health changes during a program.

2. Eligibility

You must be at least 18 years old and located in the United States to buy from this site. Programs are sold to United States residents only.

3. Coaching engagements

Coaching is a fixed-term engagement beginning on the date agreed with you. It includes the deliverables described on the coaching page and nothing beyond them unless agreed in writing.

Before coaching begins you will complete an intake, including a health screen. If your answers indicate that medical clearance is appropriate, we may require written clearance from your physician before starting, or decline the engagement. We may also end an engagement if continuing would be unsafe or if the information you provided was materially inaccurate.

Coaching is personal to you. Program materials, plans and sessions may not be shared, resold or delivered to anyone else.

4. Digital protocols and other downloads

Protocols are digital products licensed to you for your own personal, non-commercial use. You may keep and print your copy. You may not redistribute, resell, publish, or use them to coach or train other people.

Evidence summaries inside protocols describe published research as we read it. Research changes, and a recommendation that is reasonable today may not be tomorrow. Grades and citations reflect our assessment at the time of publication.

5. Payment

Prices are in US dollars. Checkout is handled by our third-party payment provider, and your payment details are processed by them rather than by us. You are responsible for any applicable taxes.

6. Refunds

Refunds are governed by our refund policy, which forms part of these terms.

7. Results

We do not promise any particular outcome. Results depend on your starting point, your health, your consistency and factors outside anyone’s control. Any result described on this site, including Tracy’s own, is that individual’s experience and is not typical or promised.

8. Our content

All content on this site and in our programs — text, protocols, images, video, branding and the Trace Elements Protocols name and marks — belongs to Trace Elements Protocols LLC and is protected by copyright and trademark law. You may not copy, reproduce or create derivative works from it except as these terms allow.

9. Third-party links and affiliates

We link to third-party products and services, including laboratory testing and supplements. Some links are affiliate links, meaning we may earn a commission if you buy through them at no extra cost to you. We disclose this wherever those links appear. We do not control third-party products or services and are not responsible for them; your dealings with them are between you and them.

10. Limitation of liability

To the fullest extent permitted by Florida law, TEP is not liable for indirect, incidental, special, consequential or punitive damages arising from your use of this site or any program. Our total liability for any claim is limited to the amount you paid us for the program giving rise to it. Nothing here limits liability that cannot be limited by law.

11. Indemnity

You agree to indemnify TEP against claims arising from your breach of these terms, your misuse of our materials, or your failure to disclose a health condition relevant to your participation.

12. Governing law and venue

These terms are governed by the laws of the State of Florida. Any dispute will be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to that venue.

13. Changes

We may update these terms. The version in force is the one published here on the date of your purchase, and the date at the top of this page shows when it last changed.
